Acceptable Use Policy

This policy applies to the Customer, the Customer's staff and anyone the Customer allows to use the Manager. Fans are covered by the event terms the Customer shows them in the Camera App, not by this policy. The Customer is responsible for fans' use of its activations only as §3 describes.
1. Why this policy exists
FANDEMiQ collects photos, videos, voices and locations from members of the public at live events, analyses them automatically and sends content back to them. That is only acceptable when fans know what is happening and have agreed to it. Most of this policy protects that.
2. General rules
The Customer must not use the Offering to:
2.1 break any law, including data protection, privacy, consumer protection, advertising and intellectual property law;
2.2 collect personal data from anyone without the notices and consents the law requires, or collect it covertly;
2.3 upload, request or distribute content that is unlawful, sexually explicit, hateful, harassing, threatening, or violent, or that infringes someone else's rights;
2.4 send fans marketing they have not agreed to receive;
2.5 access another customer's data, or try to get round access controls, rate limits, usage metering or security measures;
2.6 probe, scan or load-test the Offering, or carry out penetration testing, without FANDEMiQ's written permission;
2.7 introduce malware, or use the Offering to attack any system;
2.8 scrape, copy or reverse engineer the Offering, or use it to build a competing product;
2.9 resell or sublicense the Offering except as the Agreement allows;
2.10 share accounts, or let anyone use the Manager with another person's credentials.
3. Fans and consent
3.1 The Customer must not change, hide or add to the consent screens the Camera App presents in a way that makes them misleading, or that pre-ticks or bundles consents. It may only edit wording through the Manager's app-text settings.
3.2 The Customer must not ask fans to upload images of people who have not agreed, including through an activation's prompts or rewards.
3.3 The Customer must act promptly on any fan request that FANDEMiQ passes to it (access, erasure, withdrawal of consent), as the DPA requires.
3.4 The Customer must not use a fan's contact details for anything the fan did not agree to when they gave them.
4. Faces, voices and sensitive audiences
4.1 The Customer must not use the Offering, its outputs or its exports to identify, track or profile individual fans, and must not combine them with other data to do so. Face analysis in the Offering estimates attributes such as age range. It never identifies anyone, and the Customer must not try to make it do so.
4.2 The Customer must not use emotion or demographic estimates to make decisions about individual fans. They may be used only in aggregate, for insight and reporting.
4.3 The Customer must set an event's audience type correctly. Employee and Education audiences switch emotion analysis off because EU law prohibits it there. Setting the wrong type to get around that is a breach of this policy.
4.4 Before running an activation aimed at children, the Customer must tell FANDEMiQ so the account's minimum age can be set, and must obtain any parental consent the law requires.
5. AI features
5.1 The Customer must review AI-generated outputs before publishing them outside the Offering, for example on a website, a big screen or social media.
5.2 The Customer must not use generative features to create content that depicts a real, identifiable person in a false, sexual, degrading or misleading way, or that could be mistaken for genuine footage of a real event.
5.3 Generative features are provided through third-party AI models. The Customer must not use them in breach of the model provider's usage policies (for OpenAI, its published usage policies).
5.4 The Customer must not present AI-generated or AI-altered content to fans or the public as unaltered, where the law requires it to be labelled.
6. Content on screens and in public
The Customer is responsible for moderating content before it appears on a public display, such as a live fan wall at a venue. The Offering's automated moderation reduces risk but does not guarantee that unsuitable content is caught.
7. Enforcement
7.1 If FANDEMiQ reasonably believes this policy has been breached, it may remove content, pause an activation or disable a feature. It will tell the Customer promptly, and give reasons where the law allows.
7.2 Where the breach puts fans, other customers or the platform at risk, FANDEMiQ may act first and notify the Customer afterwards. Otherwise it will give the Customer a reasonable chance to fix the problem first.
7.3 A serious or repeated breach is a material breach of the Agreement.

8. Changes
FANDEMiQ may update this policy to reflect changes in law or in the Offering, and will give 30 days' notice of any material change by email to the Customer's admin contact.
